Problematika Investasi Emas Online: Tinjauan Fikih Muamalah terhadap Unsur Gharar

Abstract

Online gold investment is increasingly popular in the digital era, but it raises various problems of Islamic law, especially related to the concept of gharar (uncertainty). This study aims to identify and analyze the various forms of gharar contained in the practice of online gold investment and their implications for the validity of contracts in the perspective of fiqh muamalah. This research uses a qualitative method with a library research approach. The results of the study show that online gold investment contains several elements of gharar, including: unclear physical form of gold, indirect delivery mechanism, and potential speculation that resembles maysir. Several digital platforms have tried to mitigate gharar through the application of sharia standards and the supervision of the Sharia Supervisory Board (DPS). However, comprehensive regulations and people's sharia financial literacy still need to be improved so that online gold investment can run in accordance with Islamic principles
